Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and New Creation Labs LLC (“Tag,” “we,” “us,” or “our”) governing your use of the Tag mobile application, the website at tagur.it, and related services (the “Service”).

By downloading, accessing, or using Tag, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Tag is a real-time, turn-based photo “hot-potato” experience. Users capture photos under time pressure, pass them to friends or into a broader chain, and may view Tags on a map and in recaps. Features may change, be added, or be discontinued at any time.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) and capable of forming a binding contract. If you use Tag on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

• You sign in with a phone number and one-time verification code.
• You are responsible for activity on your account and for keeping access to your device secure.
• You must provide accurate profile information and keep it updated. Usernames must not impersonate others or violate third-party rights.
• We may refuse, suspend, or terminate accounts that violate these Terms or that we reasonably believe create risk or legal exposure.

4. Your content

“User Content” means photos, profile information, and other materials you submit to Tag.

• Ownership: You retain ownership of your User Content.
• License to Tag: You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes such as resizing), display, distribute, and transmit your User Content solely as needed to operate, improve, and promote the Service (including map pins, chains, recaps, and sharing features you use).
• Visibility: Depending on features you use (friends vs world), your Tags and profile details may be visible to other users.
• You represent that you have all rights needed to submit User Content and that it does not infringe others’ rights or violate law.

5. Acceptable use

You agree not to:

• Post illegal, pornographic, exploitative, hateful, harassing, or violent content;
• Bully, stalk, threaten, or harm others;
• Impersonate any person or misrepresent your affiliation;
• Upload malware or attempt to disrupt or reverse engineer the Service;
• Scrape, harvest, or collect user data without permission;
• Use Tag for spam, advertising, or commercial solicitation without our consent;
• Circumvent rate limits, authentication, or safety features;
• Use the Service if we have suspended or banned your account.

We may remove content or restrict accounts that violate these rules, with or without notice.

6. Friendships, invites & sharing

You may invite others using links such as tagur.it/u/username. You are responsible for who you invite and what you share. Do not share others’ personal information without permission.

7. Location, camera & permissions

Certain features require camera, photo library, location, contacts, or notification permissions. You can deny or revoke permissions in device settings; some features may then be unavailable. Location is used to place Tags on the map when you capture them.

8. Intellectual property

The Service—including the Tag name, logos, design, software, and branding—is owned by New Creation Labs LLC or its licensors and is protected by intellectual property laws. Except for the limited license to use the Service, no rights are granted to you.

9. Third-party services

Tag relies on third parties (for example SMS / auth providers, cloud hosting, maps, and the Apple App Store). Those services are subject to their own terms. We are not responsible for third-party services we do not control.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL BE AVAILABLE AT ALL TIMES.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEW CREATION LABS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless New Creation Labs LLC and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

13. Termination

You may stop using Tag at any time and may delete your account in Settings. We may suspend or terminate access immediately if you violate these Terms or if we discontinue the Service. Upon termination, the licenses you granted may survive as needed for content already shared with other users, and Sections 4, 8, and 10–16 will survive.

14. Changes to the Service or Terms

We may modify the Service or these Terms. We will post updated Terms on this page and update the “Last updated” date. Continued use after changes means you accept the revised Terms. If you do not agree, stop using the Service and delete your account.

15. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Exclusive venue for disputes will be the state or federal courts located in the United States, except where prohibited.

16. Miscellaneous

• These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• If any provision is unenforceable, the remainder remains in effect.
• Failure to enforce a provision is not a waiver.
• You may not assign these Terms without our consent; we may assign them freely.
